LBA POLICY AND RULES

REGARDING PRIVATE STAIRS AND ITEMS ALLOWED ON THE BEACH

 

The boardwalk, seawall and beach are all property of the Laurel Beach Association as a whole.  As such they are maintained and controlled by the Association, as are the LBA stairways at each passway leading to the beach.

 

In the past, some members owning homes on Seaview Avenue that front on the LBA boardwalk have sought to place their own private stairways from the boardwalk down to the beach directly in front of their homes to facilitate their own access to the beach – so as not to have to walk down to an LBA stairway at the closest beach passway area.  Such private stairs have been allowed in the past by the LBA Board as a courtesy to those homeowner/members.

 

All future private stairs that are installed shall require the prior written consent of the Board of Managers.  All existing private stairs (and all future private stairs) are subject to Board’s temporary license allowing their placement and use, and are the sole responsibility of the LBA member who installs them.  Such private stairways must be properly maintained, secured and placed.  The LBA member/owner of each such private stairway remains solely responsible and liable for any and all claims, injuries and concerns arising from his or her private stairway.  If in the opinion of the Board of Managers any private stairway is not being properly maintained or is unsafe, the Board may require such stairway to be removed.  If not removed promptly after notice, the Board may cause any such private stairway to be removed.  In addition, if the Board or Police Committee considers it necessary that a private stairway be removed for safety reasons because of an impending storm, the member/owner shall promptly remove such private stairway promptly upon notice, and if such member/owner is not reasonably reachable in time the Board or Police Committee may cause such private stairway to be removed.

 

Consistent with the Beach Rules, no personal property is allowed to be left on the beach (except registered watercraft in season).   Therefore no personal property of any kind may be left on the beach nor under any private stairways, nor under any registered watercraft.  No boards, platforms, nor stands of any kind are allowed on the beach.  Our beautiful beach is for all LBA members use and enjoyment. 

 

Other than approved registered watercraft, and approved, secured and maintained private stairways, NO PERSONAL PROPERTY MAY BE LEFT ON THE BEACH, INCLUDING BUT NOT LIMITED TO, FURNITURE, STORAGE CONTAINERS,UMBRELLAS, TOYS AND ANY AND ALL PERSONAL EFFECTS.
